An independent Appeal Committee has upheld an appeal by Delon Armitage of RC Toulon against the 12-week suspension imposed on him for misconduct.The Appeal Committee found that the independent disciplinary committee had made an error in how they determined the period of the appropriate sanction for the misconduct and moved to impose a suspension of eight weeks on the player.
The suspension will now run from December 17 until February 8, therefore Armitage will be free to play on February 9.
The original independent disciplinary committee had found that Armitage had directed abusive language at supporters after his club's European Rugby Champions Cup match against Leicester Tigers on December 7 and was therefore guilty of misconduct.
The independent Appeal Committee, made up of Professor Lorne Crerar (Scotland), Chairman Rod McKenzie (Scotland) and Jean-Noel Couraud (France), on Thursday (January 8) heard submissions on behalf of Armitage and on behalf of the EPCR disciplinary officer before adjourning to deliberate on the decision. The player was accompanied at the hearing by his legal representatives, Mark Milliken-Smith QC and Julian Pike.
